EME BEE CERTIFICATES AND AFFIDAVITS

What is an Exempted Micro Enterprise (EME)?


If your turnover is below R10 million per year you qualify as an Exempted Micro Enterprise (EME).


EME's are exempt from the provisions of the B-BBEE Scorecard. This means that you are automatically already B-BBEE Compliant and do not need to take any BEE measures at all or adjust your business in any way.


In order to access BEE benefits and opportunities all that is required of you is to obtain a valid EME BEE Certificate.


EME BEE Certificates under the Revised B-BBEE Codes


Under the Revised B-BBEE Codes, which became effective on 1 May 2015, EME BEE Certificates are no longer issued by external third parties, but rather are issued by the measured entities themselves by way of an Affidavit.


An EME Affidavit is statement made under oath attesting to the following:


  1. Annual Turnover below R10 million per annum

  2. The percentage of Black Ownership


(Supporting evidence in this regard will be required to be provided eg: Financial Statements)


As stated in the Revised B-BBEE Codes, EME's will obtain the following Status Levels based on their ownership credentials:


  1. Less than 51% Black Ownership – Level 4

  2. 51%-99% Black Ownership – Level 2

  3. 100% Black Ownership – Level 1


EME's are automatically deemed to qualify as Empowering Suppliers.
